These Terms and Conditions govern use of tmocarrentals.com, our online inquiry and request features, and the TMO Car Rentals SMS program. “We,” “us,” and “our” mean TMO Car Rentals. Please review these Terms before using our website or submitting a request. Where acceptance is required, we obtain it through the applicable form or transaction process.
You may use our website for lawful inquiries and rental-related purposes. Provide accurate, current information and submit information only for yourself or someone you are authorized to represent. Do not impersonate another person, submit fraudulent documents, misuse forms, interfere with site security, introduce malicious code, or collect information from our website through unauthorized automated access.
Submitting a Rental Request, joining the Vehicle Availability List, or identifying a Vehicle ID does not reserve a vehicle, guarantee approval, or create a rental agreement. Rentals are subject to vehicle availability, eligibility review, required documentation, payment requirements, and our written confirmation. A listed vehicle may become unavailable before a request is processed. We will communicate available options where appropriate.
Vehicle photographs, descriptions, categories, and features are provided for information. Representative images will be identified where used. Confirm the specific vehicle, condition, features, and permitted use with us before accepting a rental. A requested vehicle or category is not guaranteed unless expressly confirmed in writing.
Advertised rates, including “starting at” rates, depend on the applicable vehicle, rental duration, availability, and stated offer conditions. Taxes, deposits, insurance requirements, and other applicable charges will be disclosed before you commit to a rental. A website price does not authorize an undisclosed charge.
Rental eligibility, approved drivers, permitted use, insurance requirements, payment timing, deposits, cancellations, extensions, late returns, maintenance, tolls, damage, and other rental obligations are governed by your signed Vehicle Rental Agreement and separately acknowledged rental documents, including any applicable Charges and Fees Schedule. These website Terms do not add rental fees or replace those documents. If a provision conflicts on a rental matter, the signed rental agreement and applicable acknowledged rental documents control, subject to law.
Permission to use a vehicle for delivery or rideshare must be confirmed under the rental documents. We do not guarantee that any vehicle or driver will qualify for Uber, Lyft, or another platform, or guarantee earnings. Platform requirements and insurance coverage must be verified before that use.
Rewards, referral benefits, rental credits, and special offers are subject to the specific terms published with the program or offer, including eligibility, qualifying activity, redemption, and expiration rules. A website reference does not guarantee a reward. Any changes apply as described in the program terms and applicable law; these Terms do not cancel already earned benefits.
Program name: TMO Car Rentals SMS Program. We send service-related text messages to people who have consented to receive them. These may include Rental Request follow-ups, vehicle availability notices, appointment and document reminders, rental confirmations and updates, payment reminders, pickup and return coordination, maintenance notices, and customer support responses. If you separately opt in to marketing messages, we may also send rental offers, specials, and rewards promotions.
You may enroll through a clearly disclosed optional SMS checkbox on our website or forms, or another documented opt-in process. By choosing the applicable opt-in, you authorize TMO Car Rentals to send the message categories stated in that consent disclosure to the number you provide, including messages sent using automated technology. Marketing consent is separate from consent for service-related updates. Agreeing to these Terms, calling us, or entering a phone number alone does not constitute promotional SMS consent.
SMS consent is not a condition of purchasing or renting a vehicle. You may request assistance or communicate with us through other available methods. You represent that you are the subscriber or authorized user of the number provided. Notify us if your number changes or is reassigned.
Message frequency varies based on your requests, rental activity, and the messaging categories you select. Message and data rates may apply according to your mobile carrier plan. TMO Car Rentals does not charge a separate fee to receive SMS messages. Contact your carrier for plan details.
Reply STOP to any program message to unsubscribe. You may also communicate a clear opt-out request through another reasonable method, including by calling (561) 948-1081. We will honor requests promptly and within applicable legal deadlines. One nonpromotional opt-out confirmation may be sent; no further program messages will be sent unless you provide new consent. An opt-out does not cancel a rental, waive amounts owed, or change contractual obligations. Contact us to arrange another communication method.
Reply HELP for assistance, call (561) 948-1081, or visit https://tmocarrentals.com. To rejoin after opting out, use a new documented opt-in process offered by TMO Car Rentals. An unrelated inquiry does not automatically re-enroll you.
Delivery depends on mobile networks and device availability. Messages may be delayed or not delivered. Carriers are not liable for delayed or undelivered messages. Do not rely on SMS for emergency assistance. Call 911 for an emergency; use the contact instructions in your rental documents for urgent vehicle assistance.
We do not share mobile information with third parties or affiliates for marketing or promotional purposes. SMS opt-in information and consent are not sold, rented, or transferred for others’ messaging programs. Providers may process limited information solely to support our messaging on our behalf. Website text, branding, graphics, and other materials are owned by us or used with permission. You may view and use the site for personal rental inquiries. Reproducing or commercially using protected content requires permission except where law allows it. Links to external services are provided for convenience; their own terms and policies apply.
We make reasonable efforts to maintain accurate information and website availability but cannot guarantee uninterrupted or error-free operation. We may correct errors, update listings, or temporarily suspend website functions. Material changes to a confirmed rental must be handled under the rental documents and applicable law.
To the extent permitted by law, we are not responsible for indirect or consequential losses caused solely by interruption of website access or reliance on unconfirmed website information. Nothing in these Terms excludes liability that cannot legally be excluded, excuses fraud or willful misconduct, or limits rights under a signed rental agreement or applicable consumer protection law.
Florida law governs these Terms, subject to applicable federal law and mandatory rights available under other applicable law. These Terms do not impose arbitration, waive class actions, or change dispute procedures in a signed rental agreement. We may update these Terms by posting a revised version and effective date. Updated website terms do not retroactively change a signed rental or expand SMS consent.
